Former NFL wide receiver Stedman Bailey is facing a misdemeanor charge after police alleged that he engaged in sexual activity with a woman inside a Florida mall arcade.
Bailey, 35, was arrested on July 27th following an incident at Round1 inside Pembroke Lakes Mall in Pembroke Pines. A woman identified by police as Karina Manderson was also taken into custody.
Both were charged with one misdemeanor count of exposure of sexual organs, according to an arrest report obtained by PEOPLE.
Bailey acknowledged to investigators that his pants had been lowered and that he had exposed himself, but he denied that intercourse occurred.
Police Responded After a Witness Reported the Incident
According to TMZ’s initial arrest report, Bailey and Manderson had already been detained at the entertainment venue by the time Pembroke Pines police officers arrived. A witness told investigators that she saw the two engaging in sexual activity near the bar while other customers were present.
The witness alleged that intercourse was occurring and said she asked them to stop. According to the police report, Bailey then pulled up his pants before he and Manderson walked away from the area. The witness later signed an affidavit and provided investigators with a sworn recorded statement describing what she said she had observed.
Bailey Denied That Intercourse Occurred
Police said surveillance footage provided by the venue’s manager appeared to show Bailey and Manderson with their clothing lowered while other patrons were nearby. Bailey reportedly acknowledged that both had their pants down and that he had exposed himself, but he denied that penetration occurred.
According to the arrest report, Bailey attributed his actions to intoxication. He told investigators that neither he nor Manderson had consumed alcohol before arriving at Round1 and estimated that they each had approximately two or three shots at the venue.
Manderson told investigators that she did not remember the incident and believed she had consumed too much alcohol, according to PEOPLE. Police said they found no evidence that either person’s drinks had been tampered with.
Both Were Taken to the Broward County Jail
Bailey and Manderson were each booked on one misdemeanor count of exposure of sexual organs and transported to the Broward Sheriff’s Office Main Jail without incident. Manderson’s attorney, Evan Hoffman, said his office was reviewing both the circumstances of the arrest and any defenses that might apply.
“It is premature to expand on the facts or exclude any potential defenses that may be available,” Hoffman said in a statement provided to NBC Miami. He also asked that no conclusions be reached about his client while the case remains pending. PEOPLE reported that Bailey’s attorney declined to comment.
Bailey Played Three Seasons With the Rams
The St. Louis Rams selected Bailey in the third round of the 2013 NFL Draft after his college career at West Virginia. His official NFL statistics show that he appeared in 38 regular-season games from 2013 through 2015, recording 59 receptions for 843 yards and two receiving touchdowns.
Bailey’s playing career was interrupted in November 2015 when he suffered life-threatening injuries after being shot twice in the head in Miami Gardens. The Rams waived him with a non-football injury designation in 2016. Although Bailey later pursued a comeback, he did not appear in another NFL regular-season game.
