Bailey Zimmerman’s Criminal Charges Dropped After $16K Hotel Room Damage Case

Bailey Zimmerman is no longer facing criminal charges after a New Mexico hotel room damage case that began with an arrest warrant and a canceled concert.

The country singer had been accused of causing more than $16,000 in damage to a room at Sandia Resort and Casino in Albuquerque after canceling a May 27 show shortly before it was set to begin.

People reported that the Bernalillo County District Attorney’s Office dismissed the case after Zimmerman made full restitution. TMZ also reported that prosecutors dropped the charges after the hotel was paid.

Zimmerman had been facing a fourth-degree felony charge for criminal damage to property and a misdemeanor charge for falsely obtaining services. The allegations were not decided at trial.

Prosecutors Dropped the Case After Restitution

A representative and lawyer for Zimmerman told People that the charges were dropped after he took “immediate responsibility” for his mistake.

“We are grateful to the Pueblo of Sandia and the District Attorney’s Office for this just and swift resolution,” they said in a statement to the outlet.

People reported that the warrant had been issued on June 18 after repeated attempts to contact Zimmerman about the incident were unsuccessful.

The Affidavit Described a Chaotic Night Before the Canceled Show

According to an arrest warrant affidavit obtained by People, Zimmerman “appeared to be exhibiting signs of intoxication” during interactions with staff and during soundcheck at the Sandia Resort and Casino amphitheater.

The affidavit alleged that he stumbled onstage, hit a guitar on the ground, threw two cymbals, kicked a drum set, pushed a guitarist and threw a microphone before leaving the stage angrily.

Page Six reported additional affidavit claims that Zimmerman allegedly burned bandmates with a cigarette before the hotel room damage was discovered.

Zimmerman canceled the May 27 show shortly before it was scheduled to begin. People reported that he told fans at the time that he had not been feeling well and could not give them the show they deserved.

The affidavit said Zimmerman returned to the resort from soundcheck with blood visible on his knee, was seen stumbling toward his room and was later asked to leave the property. According to People, police were called after he became disorderly, though he eventually left.

The next morning, housekeeping found damage in the room, including a broken phone, a damaged television, damaged furniture, two missing chairs and a hole in the wall, according to the affidavit. People reported that Zimmerman was also accused of leaving more than $400 in unpaid alcohol charges.

Zimmerman Apologized to the Pueblo of Sandia and Fans

Before the charges were dropped, Zimmerman issued a public apology for the canceled show and the reports that followed.

“First things first, I want to apologize to the Pueblo of Sandia and to everyone at Sandia Resort & Casino,” he said in a statement reported by People and TMZ. “I never meant for any of this to come across as disrespectful.”

Zimmerman also apologized to fans who bought tickets, saying they “deserved better” from him. He said he understood that being a musician comes with responsibilities on and off stage and that he fell short that day.

“I am taking this legal matter seriously,” he said. “I am committed to doing the work necessary to learn and grow.”
