Tyler Herro and Katya Elise Henry’s custody dispute became public in September, but newly reported court records show they had stopped sharing a home long before either parent went to court.
Henry and the former couple’s two children moved out of Herro’s Miami residence in February 2025, according to court documents obtained by TMZ Sports. The filing says Henry and the children had lived with Herro from September 2021 through January 2025 before moving into another home a few miles away.
About 18 months later, Herro and Henry both filed petitions on Aug. 20 concerning custody, a parenting plan and financial support for their two children. Herro dismissed his case less than a week later, while Henry continued pursuing hers.
Herro and Henry were still seen arriving together at NBA Summer League in Las Vegas in July 2026, more than a year after the records indicate they had begun maintaining separate homes.
Both Parents Filed Court Petitions on the Same Day

Herro and Henry both filed petitions on Aug. 20 concerning their two children, a daughter born in 2021 and a son born in 2023. According to TMZ’s initial report on the filings, Herro asked the court to establish a parenting schedule and determine his child-support obligation. He also said he had already been voluntarily providing financial support.
Herro dismissed his petition several days later. Henry’s case remained active. She described herself as the children’s primary caregiver and said she had made most of the major decisions involving them. Her filing asks the court for primary custody, a formal parenting plan and court-ordered child support.
Henry also pointed to the disparity between the parents’ incomes, citing Herro’s earnings as a professional basketball player as one of the factors she wants the court to consider when determining support.
Henry Asked for Safeguards but Did Not Detail Her Concerns
Henry’s petition also asks the court to place conditions around Herro’s parenting time. She referred to what the filing describes as his “historical conduct” and requested “safeguards and parameters” on a temporary and permanent basis for the children’s safety and well-being.
According to TMZ, she said those details were “intentionally omitted” out of respect for Herro. Henry also said she wants the children to maintain a relationship with their father, making the request one for court-imposed conditions.
They Were Still Appearing Together Long After They Stopped Sharing a Home
On July 10, TMZ filmed Herro arriving with Henry at NBA Summer League. The outlet referred to her as his girlfriend at the time and showed the two walking into the event together.
That appearance came roughly 17 months after Henry and the children had moved into their own residence, according to the court records later reported by TMZ. Neither Herro nor Henry has publicly identified the exact date their romantic relationship ended.
Herro’s professional situation also changed shortly before the custody filings. The Milwaukee Bucks agreed to acquire him from the Miami Heat in June as part of the blockbuster Giannis Antetokounmpo trade, and the deal was formally completed in early July. The NBA now lists Herro as a Bucks guard.
