Halle Berry Spends Day With Son Maceo After Judge Restricted Her Visits — Then Asks to Restore 50/50 Custody

Halle Berry spent Sunday with her son, Maceo, before asking a Los Angeles judge to restore the parenting arrangement she previously shared with ex-husband Olivier Martinez. Her request, filed Monday, Oct. 5, seeks a return to their 2023 agreement for 50/50 custody, Entertainment Weekly reported.

A temporary restraining order issued Oct. 1 changed Berry’s parenting time but allowed her to continue seeing her son during specified daytime hours. The order covered both Martinez and Maceo, according to records reviewed by PEOPLE.

Martinez sought protection after alleging that Berry physically attacked Maceo during a Sept. 26 dispute. Her attorney, Marina Beck, denied his account and called the filing “entirely meritless and deliberately misleading.”

Berry, 60, was accompanied on the Oct. 4 visit by her fiancé, musician Van Hunt. They spent time together one day before Maceo’s 13th birthday.

Berry Watched Maceo Play Soccer Before a Shopping Stop

An eyewitness told PEOPLE that Berry chatted with Maceo at a Los Angeles Sky Zone before he joined an indoor soccer game. She and Hunt watched from nearby. When a fan approached for a selfie, Berry declined because she was spending time with her child. TMZ also published BACKGRID footage of the trio shopping at Best Buy that day.

Berry Wants Court-Ordered Counseling to Resume

Berry also asks that Martinez resume court-ordered therapy. She accuses him of making unilateral decisions about Maceo’s education, undermining her relationship with their son and involving him in private disagreements, according to documents reviewed by PEOPLE.

She describes Hunt as important in Maceo’s life and alleges Martinez has resisted family therapy involving him. Martinez opposes her request, arguing that Maceo faces an immediate safety risk and that Berry should proceed through a regularly scheduled custody hearing.

Under a May 2024 agreement, each parent was to meet individually with a mutually selected coach before taking part in six joint sessions. The coach would then decide whether further sessions were needed, according to PEOPLE. Hunt was permitted to participate. That August, Berry sought sole legal custody or final authority over school and treatment decisions, E! News reported.

School and Treatment Decisions Are Separate From Parenting Time

TMZ reported that Monday’s amendment preserved Berry’s final authority over Maceo’s education and mental-health care. Under California’s custody rules, legal custody concerns decisions about a child’s health, education and welfare, while physical custody concerns where the child lives.

The state’s Family Code defines joint physical custody as each parent having significant periods of custody, arranged to provide frequent and continuing contact with both parents. The definition does not prescribe an equal division of every week; the parenting schedule establishes when the child spends time with each parent.

The Court Will Hear Both Parents’ Arguments This Month

Messages included in Martinez’s application show Berry expressing regret after the disagreement and asking him to encourage Maceo to speak with her, according to PEOPLE. Christopher C. Melcher, a California family-law attorney unconnected to the case, disputed the view that the exchanges established what happened during the argument.

Melcher told PEOPLE that the temporary restrictions were not a final determination of the allegations. Attorney Monica Mazzei, also uninvolved in the case, said the judge would review both sides’ filings and hear arguments before deciding whether a longer-term restraining order was warranted.

The judge also denied Martinez’s request for sobriety monitoring, citing “insufficient information,” according to PEOPLE’s account of the initial order. The publication reported that Berry was directed to attend mediation on Oct. 14. The restraining-order hearing is scheduled for Oct. 16.
